Terms & Conditions

These Terms & Conditions govern access to Wapello County Busted Mugshots. By using the site, visitors agree to follow these terms and all applicable laws. Anyone who does not agree should stop using the site. The service is a private records-navigation resource, not a government office, record custodian, law firm, or consumer reporting agency.

Private Site and Government Records

Wapello County Busted Mugshots is privately owned and operated. It is not affiliated with, approved by, or acting for Wapello County, the Wapello County Sheriff’s Office, Wapello County Jail, Ottumwa Police Department, an Iowa court, the Iowa Department of Corrections, BOP, ICE, or any other government body.

The site provides explanations and links to records controlled by outside custodians. It cannot confirm a person’s custody, release someone, correct a docket, supply a certified document, or promise that an agency will disclose a record. Iowa public-record requests remain subject to Iowa Code chapter 22 and any other applicable confidentiality rule.

Permitted and Prohibited Use

Visitors may use the site for lawful, personal, purpose-neutral records navigation. Access must not be used to violate privacy, harass or threaten anyone, impersonate another person, disrupt the service, introduce malicious code, scrape or copy the site at scale, bypass access controls, probe security, make false statements, or break any local, state, or federal law.

No visitor may present this site’s text as an official Wapello County record, alter its branding to suggest a government connection, or use an automated system that burdens the service. Attempts to obtain restricted records, interfere with another user, or exploit site functions are forbidden.

FCRA Use Is Forbidden

This site is not a consumer reporting agency under the Fair Credit Reporting Act and does not provide consumer reports. Its information must not be used for credit, employment, tenant screening, insurance, or any other FCRA-regulated purpose.

Users are solely responsible for choosing a lawful purpose and for complying with all laws that govern their actions. Public availability of an arrest record does not make every later use lawful. A booking or charge is an accusation, not proof of guilt, and every person is presumed innocent unless a court enters a conviction.

Third-Party Links and Tools

The site links to government portals, courts, corrections systems, news publishers, search providers, advertisers, and other independent services. An outbound link is supplied for convenience and does not mean the destination, its content, prices, results, security, or practices are endorsed. Each outside operator sets its own terms and privacy rules.

Sponsored search tools are controlled by independent providers. Search queries and transactions made through those tools are between the visitor and provider. Wapello County Busted Mugshots is not responsible for an outside service’s availability, result, fee, contract, or handling of data.

No Warranties

The site and all content are provided “as is” and “as available.” To the fullest extent permitted by law, all express and implied warranties are disclaimed, including warranties of accuracy, completeness, currency, availability, merchantability, fitness for a particular purpose, title, and noninfringement.

Government databases and news pages can change without notice. A jail entry may expire from a public view, a charge may be amended, and a link may fail. No promise is made that access will be uninterrupted, secure, error-free, or suited to a visitor’s objective. Verify material with the office that created it.

Limits on Liability

To the maximum extent Iowa law allows, the site owner, operators, contributors, and service providers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, lost data, lost profits, reputational harm, or other loss arising from access, inability to access, reliance on content, use of an outside link, or conduct by another person.

Where a complete exclusion is not allowed, liability will be limited to the smallest amount the law permits. Nothing in these terms excludes a duty or liability that cannot legally be waived.

Indemnification

A visitor agrees to defend, indemnify, and hold harmless the site owner, operators, contributors, and service providers from claims, losses, liabilities, damages, judgments, costs, and reasonable legal fees arising from that visitor’s misuse of the site, violation of these terms, infringement of another party’s rights, or violation of law. This obligation applies only to the extent permitted by law.

Intellectual Property

The site’s original writing, arrangement, branding, design elements, and other owned material are protected by applicable intellectual-property laws. Limited personal use does not transfer ownership. Republishing, selling, modifying, or distributing substantial site content without permission is prohibited except where law expressly allows it.

Government records, agency names, linked materials, and third-party marks remain the property of their respective owners. Their appearance does not establish sponsorship or grant a license to use them.

Changes and Access

These terms may be revised when site functions, vendors, or legal requirements change. A revised version becomes effective when posted unless it states another date. Continued access after a change indicates acceptance of the current terms.

Access may be suspended, limited, or revoked at any time for suspected misuse, a security concern, a legal requirement, or violation of these terms. Features may also be changed or discontinued without notice. Sections that logically should continue, including ownership, disclaimers, liability limits, indemnification, and governing law, survive termination.

Iowa Law and Severability

These terms are governed by the laws of the State of Iowa, without regard to conflict-of-law principles, except where federal law controls. Any dispute must be brought in a court with proper jurisdiction and venue under applicable law.

If a court finds one provision invalid or unenforceable, that provision will be limited or removed only as much as necessary. The remaining provisions continue in effect. A failure to enforce a term once is not a waiver of the right to enforce it later.
